Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Bronker ("Bronker," "we," "us," or "our"), an on-chain marketplace where creators launch tokens with NFT packs and collectors trade, unlock art and earn into NFT backpacks.

By accessing or using the Platform including our websites, interfaces and related services you agree to these Terms. If you do not agree, do not use Bronker.

2. The Platform

Bronker provides interfaces that help users discover packs, launch tokens, trade collection tokens, buy and sell NFTs from vaults and manage backpack wallets. Bronker features a distinctive retro pixel-art aesthetic and minimalist dark interface.

Bronker is a non-custodial interface layer. We do not take custody of your digital assets. Transactions you submit are executed by you through your own wallet on public blockchains or third-party protocols.

3. Eligibility

You must be at least 18 years old and legally able to enter a binding agreement. You may not use Bronker if applicable law prohibits you from doing so, including sanctions or other restrictions in your jurisdiction.

4. Wallets and accounts

You access certain features by connecting a compatible blockchain wallet. You are solely responsible for your wallet, private keys, seed phrases and all activity under addresses you connect. We cannot recover lost keys or reverse confirmed blockchain transactions.

5. No advice

Information shown on Bronker including project pages, quotes, docs and market data is for convenience only and does not constitute financial, investment, legal or tax advice. You remain solely responsible for evaluating risks and deciding whether to take any action.

6. Risks of on-chain activity

Interacting with decentralized markets, tokens, NFT vaults, bonding curves, liquidity pools and smart contracts involves substantial risk, including total loss of funds, smart-contract bugs, oracle failures, volatility and interface or network outages. You acknowledge these risks and use Bronker at your own risk.

7. Acceptable use

You agree not to:

• Use Bronker for unlawful activity, fraud, market manipulation or sanctions evasion
• Interfere with Platform security, scrape abusively or attempt unauthorized access
• Misrepresent your identity or the nature of tokens or projects you launch
• Use the Platform in a way that harms other users or underlying protocols

8. Intellectual property

Bronker's branding, pixel-art characters, interfaces, software and content are owned by Bronker or its licensors. You receive a limited, revocable, non-exclusive license to use the Platform for its intended purpose. You may not copy, modify or reverse engineer the Platform except as allowed by law.

9. Third-party services

Bronker may link to or integrate third-party protocols, bridges, oracles, wallets and content. We do not control and are not responsible for third-party services. Your use of them is governed by their own terms.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ACCURATE OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRONKER AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR DIGITAL ASSETS, ARISING FROM YOUR USE OF BRONKER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US (IF ANY) FOR ACCESSING THE PLATFORM IN THE TWELVE MONTHS BEFORE THE CLAIM.

12. Indemnity

You agree to indemnify and hold harmless Bronker and its affiliates from claims, damages and expenses arising from your use of Bronker, your on-chain activity or your violation of these Terms.

13. Changes and termination

We may modify these Terms or suspend or discontinue the Platform at any time. Material changes will be indicated by updating the "Last updated" date. Continued use after changes constitutes acceptance. We may suspend access for conduct that violates these Terms or creates risk.

14. Governing law

These Terms are governed by applicable law without regard to conflict-of-law principles, except where mandatory local consumer protections apply. Disputes will be resolved in courts or forums of competent jurisdiction unless applicable law requires otherwise.
